This Privacy Policy explains how we collect, use, disclose, and protect personal information when you use our commercial debt collection and accounts receivable management platform.

2.1 From Merchants (Our Clients)

  • Business name, ABN, and contact details
  • Account credentials and authentication information
  • Payment and billing information
  • Invoice and debtor data you upload to our platform
  • Integration credentials (e.g., Xero, MYOB)

2.2 From Debtors (Business Entities)

  • Business name and contact information (as provided by merchants)
  • Communication preferences
  • Payment information when making payments
  • Correspondence and communication history
  • Hardship application information (if applicable)

2.3 System and Compliance Data

We automatically collect operational data to ensure regulatory compliance, including:

  • Metadata regarding the frequency and timing of contact attempts
  • Compliance check logs (contact limits, permitted hours)
  • Hardship detection triggers and responses
  • Audit trails for all financial transactions

This data powers our Governor Service compliance engine and provides evidence of regulatory adherence.

3. How We Use Your Information

We use personal information to:

  • Provide and improve our commercial debt collection services
  • Process payments and manage accounts
  • Communicate about outstanding debts in compliance with ASIC Regulatory Guide 96
  • Assess and manage hardship applications
  • Comply with legal and regulatory obligations
  • Prevent fraud and ensure platform security

4. Disclosure of Information

We may disclose personal information to:

  • Our merchant clients (regarding their debtors)
  • Payment processors (Stripe) for transaction processing
  • Service providers who assist in our operations

We do not sell personal information to third parties for marketing purposes.

4.1 Accounting Software Integrations (Xero, MYOB)

When you connect your accounting software, we only access the specific data points required to facilitate recovery:

  • Invoices (number, amount, due date, status)
  • Contacts (name, email, phone for debtor communication)
  • Payments (to reconcile amounts received)

We do not access your complete chart of accounts, bank feeds, payroll data, or other financial records unrelated to accounts receivable. We do not use your data for marketing purposes or sell it to third parties.

5. Data Security

We implement appropriate technical and organisational measures to protect personal information, including:

  • Encryption of data in transit and at rest
  • Secure cloud infrastructure with Australian data residency
  • Access controls and authentication measures
  • Regular security assessments
  • Employee training on data protection

6. Your Rights

Under the Privacy Act, you have the right to:

  • Request correction of inaccurate information
  • Complain about a breach of the APPs
  • Request deletion of your information (subject to legal requirements)

7. Credit Reporting

DebtForce may, where authorised and with appropriate commercial agreements in place, access or report information to credit reporting bodies in accordance with Part IIIA of the Privacy Act. This may include:

  • Credit enquiries
  • Default information
  • Payment history information

Credit reporting features are only available where DebtForce has established commercial agreements with credit reporting bodies and where you have opted into these services. You have the right to access your credit information and request corrections.

If you are experiencing financial hardship, we are committed to treating you fairly and with respect. Please contact us or use our online hardship application to discuss your situation. We will handle your hardship information with additional care and confidentiality.
